How Is Pain and Suffering Calculated?

Two methods dominate: the multiplier method (economic damages × a severity factor, usually 1.5-5) and the per diem method (a fixed dollar amount per day of recovery). The multiplier method is more common in practice, especially for insurance adjuster negotiations. Neither method is a legal requirement — both are negotiation tools, and actual settlements depend on the specific facts of the case.
